NOW: mining reclamation act

HB2317 exempts mines from even more regulation by prohibiting the counties from regulating reclamation activities via ordinances.  Just when you thought there was no place left in the statutes where the mines were not exempt, here it is.  This makes a bad statute even worse – there are already major exemptions for mining (including sand and gravel) and significant limits on what a county can do in this area.  Local government should be able to develop and implement ordinances that help to ensure there are fewer conflicts between mining activities and other land uses.  That includes reclamation.

Status

The Governor has until early next week to decide whether or not to veto, sign or just let this stinker become law without her signature.
